Public Hearing was opened by Richard Maloney at 7:37.

ZBA 2011-17 Application for a 10’ variance for sign (Section 19.07.02.01.01) at 156 River Road The Mill Works (Map 15 Lot 27A Zone R80) Owner/Applicant: Thomas Buccino (Received Nov 18, 2011 Public Hearing Dec ember 8, 2011 continued to January 12, 2012 Decision within 65 days after close of P.H.)

Richard Maloney stated that a site walk was done on December 17, 2011. R. Maloney, A. Poole, M. Masinda & W. Bland were present. The first location was the Mill Works at 156 River Road, where they look at the proposed location of the sign.
Mr. Buccino was present to speak about his application. R. Maloney state that there were concerns about the location of the sign being in a state right of way. Mr. Buccino state that he spoke with Michael Shea at the Department of Transportation. M. Shea sent maps of the area showing that part of route 32 was unbounded. He was planning a site visit to walk the area. Mr. Buccino stated that the site walk was not done. At this point he had no additional information except the maps that  Mr. Shea sent. Copies of the maps were added to the application.
R. Maloney asked if anyone wanted to speak either for or against the application.
Crista Grasso spoke in favor of the application.
J. Rup asked if there was an entrance and exit between the buildings were the sign will be located. Would the sign obstruct the line of vision?  There would be clear visibility in both directions.
The Board Members discussed the location of the sign and the Regulations on Right of Way.
Mr. Buccino requested a 30 days extension until February 9, 2012 on his application
Public Hearing to remain open.

ZBA2011-19 Application for Special Exception 1,055 sq ft office & studio space for  digital photography and online jewelry and bead sales at 156 River Road (Map 15 Lot 27A Zone R80) Owner: Thomas Buccino Applicant: Crista Grasso & Jeremy Pollack (Received December 8, 2011 Public Hearing January 12, 2012 Decision within 65 days after close of P.H.)
Crista Grasso & Jeremy Pollack were present to speak about their application. It will be a shared office space. Crista Grasso stated that she will have one employee that will be  making jewelry and packaging and shipping beads from  this location. Jeremy Pollack is a commercial photography for products and will be using the space for editing and on line sales. Parking for this location will be 2 spaces. Application is complete. R. Maloney asked if anyone wanted to speak either for or against the application. Alice Cassells was present to speak in favor of the application.
Public Hearing closed at 8:15.

ZBA2011-20 Application Special Exception 2,475 sq ft office for software development at 156 River Road (Map 15 Lot 27A Zone R80) Owner: Thomas Buccino Applicant: Medical WEB Technologies (Received December 7, 2011 Public Hearing January 12, 2012 Decision within 65 days after close of P.H.)
Eric Akstin was present to speak about the application. E. Akstin stated that the space will be used to develop and write computer soft ware. Their will be three employees using the space 2 to 3 days a week.  Three parking spaces will be needed. Approval from EHHD is in the file.  R. Maloney asked if anyone wanted to speak either for or against the application. Alice Cassells was present to speak in favor of the application.

.ZBA2011-21 Application Variance to regulation section 4.04.02.01 minimum buildable area (slope requirement) at Jared Sparks Road (Map 37 Lot 12 Zone R80) Owner/Applicant: Liesa M Falwell-Siekowksi Received December 8, 2011 Public Hearing January 12, 2012 Decision within 65 days after close of P.H.)

Richard Maloney stated that a site walk was done on December 17, 2011. R. Maloney, A. Poole, M. Masinda & W. Bland where present. Bruce Woodis a land survey with KWP Associates was present to speak on behalf of the applicant. B. Woodis stated that his company prepared the plans for the applicant. B. Woodis handed out copies of a tax map with the lot highlighted and gave a brief history of the property. B. Woodis explained that the lot does not meet the current regulation for no slope greater than 15%. Hardship is that the lot was already a lot and up until last year met all the requirement of the subdivision and zoning regulation. We are asking for relief from the new regulation so the subdivision can be approved. S. Schrager explained to the Board Members that they had tried to submit the application before the subdivision regulations changes were made but a moratorium was in place.
J. Rup asked about a change in the side line. B. Woodis explained that they made the correction to conform to the new regulations.
R. Maloney asked if anyone wanted to speak either for or against the application.
Mr. Mindek an abutting property owner spoke about his concerns about the springs on the property that run into his pond.
Rebecca Kimbrough was present to speck in favor of the application.
Public Hearing closed

R. Maloney opened the regular meeting at 8:15.

Letter was submitted from the applicant withdrawing his application.
